The Atlanta Volunteer Lawyers Foundation (AVLF) seeks volunteer attorneys for its Eviction Defense Phone Bank to speak with Fulton County tenants who have pending evictions. Many of these tenants are seeking only simple advice and consultations about eviction cases - how they work, what the steps in the process are, and how best to raise their defenses or counterclaims. This opportunity is a brief advice volunteer bank to assist these tenants. Before your shift, you will receive a list of tenant names, phone numbers, and case summaries. These tenants have been pre-screened by an AVLF volunteer attorney and identified as needing brief advice. Questions? Atlanta Volunteer Lawyers Foundation (AVLF) hosts a Saturday Lawyer Program clinic nearly every Saturday of the year. Volunteers can choose to sign up for either an in-person day at our downtown office (the first Saturday clinic of each month) or a virtual day via Zoom (all other Saturdays). Attorneys meet with potential clients to hear the details of their situation involving housing, landlord, or eviction concerns. Law students and/or paralegals may also assist in the interview to provide additional support to the attorney and client. After the interview, the volunteer attorney will debrief with an AVLF staff attorney to determine if the case has merit, and if the volunteer is able to take on representation (encouraged but not required). HCAC is a walk-in advice clinic for Atlanta tenants whose landlords are taking them to court. Located in the Fulton County Courthouse, tenants can get immediate advice about the eviction process (which in Georgia is known as a dispossessory). With the help of an AVLF staff attorney, volunteer attorneys and law students/paralegals meet with tenants onsite to explain their rights under Georgia law. From limited advice on completing an Answer to pre- and post-litigation advice, HCAC provides tenants with the knowledge and resources they need to advocate for themselves throughout the eviction process. Atlanta Volunteer Lawyers Foundation (AVLF) seeks volunteer attorneys to represent landlord-tenant cases. AVLF has dozens of vetted cases waiting to be accepted by volunteer attorneys in order to support low-income tenants with landlord issues such as failure to repair, conditions, rent dispute and more. Many of these cases may only need help in the form of a demand letter or other negotiation, while some may require litigation. Landlord-Tenant law experience is not required, as we have staff attorneys and paralegals available to help and provide guidance every step of the way as well as additional volunteer support available (forensic accountants, law students and paralegals, etc). An active, in-good-standing GA Bar license is required. Questions? Contact AVLF (volunteer@avlf.org). A common case summary is listed below for reference. PC is still waiting on repairs that she requested when she moved in 4 years ago. Her tub was not draining and was in jeopardy of overflowing. There has been mold in her daughter's room for about a year, causing her daughter to get very sick and damage to her personal belongings. Her daughter had to visit the ER several times. PC had to live with an exposed ceiling for months. The ceiling there still has water damage; the landlord simply sprayed it. AVLF performed a mold test, which revealed high levels of humidity, allergen spores and water damage throughout the home. The AC didn’t work for two weeks, so PC’s family had to stay at a hotel and then purchase additional fans. There were at least two changes in ownership/management, resulting in PC’s requirement to pay online only, with an additional convenience fee. Now, two of the three toilets will not flush properly and the third one runs nonstop; the smoke detectors don't work; the kitchen sink cabinet is rotten and sinking in; the half bathroom floor is partially stripped; there’s an AC leak that’s damaged the floor; one of the tubs is constantly stopped up; and her bedroom window does not fully close. PC would like assistance with getting repairs done and some of her rent returned, reimbursement for damaged belongings, and to break her lease without penalty if she can find an affordable home.
