We are a small, nonprofit, healthcare organizations in need of legal advice regarding employee law to advise us regarding issues such as:
1. Determining whether hired therapists are part-time employees or independent contractors or determining how to make it so they can be considered independent contractors by the EDD. Counseling services is within our mission statement. Can we hire BBS licensed therapists and simply consider them independent contractors? or is there more to it? Does the ABC Test apply to us?
2. Best practices to avoid problems and liability with staff and regulatory agencies.
3. Aside from purchasing E&O insurance, what else should we be doing to protect officers and board members from liability? Is there a form or agreement we're supposed to use with board members?
4. Aside from having volunteers sign a waiver of liability form, what else should we be doing to effectuate true liability protection for the organization?
5. Reviewing the legal forms we use for various purposes including client counseling contracts, volunteer waiver forms, independent contractor and employee contracts.

The purpose of the Center for Japanese Mental Health is improve the mental health and well-being of people of Japanese descent by education, advocacy and outreach; development and administration of mental health programs and counseling services; professional development, training and support of mental health providers and caregivers; and research for the furtherance of the preceding goals.
