First Year of F-1 OPT? Maintain Status By Volunteering.

If you're a foreign national with a nonimmigrant status has a student with F-1 or OPT EAD, it can be frustrating to figure out how to maintain status in the USA. You have options as described in SEVP Policy Guidance 1004-03 Update to Optional Practical Training:


An F-1 OPT international student may work as a volunteer or unpaid intern, where this practice does not violate any labor laws. The work must be at least 20 hours per week for a student on post-completion OPT. A student must be able to provide evidence acquired from WHOMENTORSDOTCOM INC. to verify that the student worked at least 20 hours per week during the period of employment.

In determining whether a volunteer has provided services to WHOMENTORSDOTCOM INC., a Delaware Charitable Nonstock Exempt Corporation qualified under Section, 501(c)(3) of the Internal Revenue Code as a tax-exempt organization, without promise, expectation, or receipt of any compensation for work performed, courts in the United States of America, consider the strength of the volunteer’s non-employee affiliation with the organization, the organization’s ability to initiate, or request services from the volunteer, the organization’s supervision over the volunteer’s work, and the volunteer’s accountability to the organization.

Micro-volunteering (temporary work tasks accepted by other nonprofits) generally refers to easy, no-commitment, cost-free actions that take less than 30 minutes to complete. WHOMENTORSDOTCOM INC. supervises genuine and substantial duty of volunteers and trainees to accomplish its 501(c)(3) exempt purposes. The charity work the volunteer or executive trainee is involved with has to be real and substantial throughout. Therefore, strong affiliation is required, meaning each volunteer is asked to advance their own funds for the operation of the organization by remitting an annual registration fee and a monthly supervision fee (covers insurance, expenses incurred by the corporation).
